- The Buyer may collect the Product in person after contacting the Seller to agree on the date and place of collection.
- Products are delivered to the address indicated in the Order by courier companies cooperating with the Seller.
- In any case, the Goods will be released no earlier than upon payment of the full Order price. After two delivery attempts, unless the courier company’s service rules provide otherwise, the order will be cancelled and returned to the Seller. If the Customer has paid for the Order, all funds will be refunded using the same payment method used by the Customer, unless the Buyer agrees to a different refund method.
- Until the Goods are collected by the Customer, they remain the property of the Seller.
- The order fulfilment time is counted from the moment the payment is successfully authorised.
§ 10 WARRANTY
- Goods offered by the Seller are covered by the manufacturer’s warranty.
- Detailed warranty information is available on the Online Store website under the “Warranty” tab.
§ 11 COMPLAINTS
- The Seller undertakes to deliver to the Consumer a Product that is in conformity with the Agreement and free from physical and legal defects. Goods are in conformity with the Agreement if:
- their type, quantity, quality, completeness and functionality are as stated in the Product description;
- they have the durability and safety that are typical for products of that kind and that the Consumer may reasonably expect, taking into account the nature of the Product and any public statements made by the Seller;
- they are fit for the purposes for which Products of the same type are normally used, taking into account applicable laws, technical standards and good practice;
- they are supplied with the packaging, accessories and instructions that the Consumer may reasonably expect or that result from the Product description.
- The Seller is liable to the Consumer for the conformity of the Goods with the Agreement in accordance with the Polish Consumer Rights Act of 30 May 2014.
- The Seller is liable for any lack of conformity of the Product with the agreement that existed at the time of delivery and becomes apparent within 2 years of delivery of the Product to the Consumer. A lack of conformity that becomes apparent within two years of delivery of the Product is presumed to have existed at the time of delivery, unless proven otherwise or unless this presumption is incompatible with the nature of the goods or of the lack of conformity.
- The Consumer may not withdraw from the agreement if the lack of conformity of the Product with the Agreement is minor.
- Slight aesthetic differences in the external appearance of the Product compared with its graphic presentation in the Online Store, which may result from different monitor settings, lighting conditions, etc., are not grounds for a complaint.
- The Consumer may submit a complaint:
- by e-mail to: store@snappform.com;
- in writing to: ul. Stefana Batorego 18 lok. 108, 02-591 Warsaw, Poland, marked “Complaint”;
- via the Account (user account).
- The complaint should include:
- the Consumer’s full name;
- proof of purchase of the Product (a copy of the receipt or invoice, a card payment printout or a transfer confirmation);
- a correspondence address;
- an e-mail address, if the Customer wishes to receive the response to the complaint by e-mail;
- the date of purchase of the Product;
- the type of Product;
- a detailed description of the lack of conformity of the Product with the agreement;
- the date on which the lack of conformity was discovered;
- photos or a video of the Product showing the defect.
- The Consumer should also indicate their preferred way of being informed about how the complaint has been handled.
- If the complaint is incomplete, the Seller will ask the Consumer to complete it.
- If the Product is not in conformity with the agreement, the Consumer may request:
- repair of the Product;
- replacement of the Product with one that is in conformity with the agreement.
- Instead of the remedy chosen by the Consumer, the Seller may replace the Goods with goods free from defects, or instead of replacing the Product, remedy the lack of conformity (by repairing it), if bringing the Product into conformity in the way chosen by the Consumer is impossible or would require excessive costs for the Seller.
- The Consumer may declare a price reduction or withdrawal from the agreement if: the Seller has refused to bring the Product into conformity with the agreement; the Seller has not brought the Product into conformity with the agreement; the lack of conformity persists even though the Seller has tried to bring the Product into conformity with the agreement; the lack of conformity is so significant that it justifies a price reduction or withdrawal from the agreement without first using repair or replacement; or it is clear from the Seller’s statement or the circumstances that the Seller will not bring the Product into conformity with the agreement within a reasonable time or without excessive inconvenience to the Consumer.
- The Seller will consider the complaint promptly, no later than within 14 (fourteen) days of receiving it.
- In the case of replacement or bringing the Product into conformity with the agreement, the Seller will collect the Product from the Consumer at its own expense.
- After considering the complaint, the Seller will send the Product back to the Consumer at its own expense. If the complaint was unjustified, the Seller may charge the Consumer the shipping cost.
- If the Goods are not collected by the Consumer and are returned to the Seller’s registered office, the Seller will contact the Consumer at the e-mail address or phone number provided in the complaint and inform them that the Product can be resent at the Consumer’s expense. In that case, the Consumer has 30 days to collect the Product or request that it be resent. After this period, the Goods will be transferred to the Seller’s logistics facility, and the Seller may charge the Consumer storage costs or, if there is no storage space, dispose of the Product at the Consumer’s cost and risk.
§ 12 WITHDRAWAL FROM THE AGREEMENT
- A Consumer who has concluded a distance contract or an off-premises contract has the right to withdraw from it within 14 days without giving any reason.
- The withdrawal period starts:
- for agreements under which the Seller delivers a Product and is obliged to transfer its ownership – from the day the Consumer, or a third party other than the carrier indicated by the Consumer, takes possession of the Product or downloads the Digital Content; for an agreement covering several Products delivered separately, in batches or in parts – from taking possession of the last Product, batch or part;
- for other agreements – from the day the agreement is concluded.
- The above right also applies to a natural person running a business who concludes an agreement directly related to their business activity, where the content of the agreement shows that it is not of a professional nature for that person, resulting in particular from the subject of their business activity as disclosed in the Central Register and Information on Economic Activity (CEIDG).
- In the event of withdrawal from a distance contract, the contract is deemed not to have been concluded.
- In the event of withdrawal, the Customer must return the Product within 14 days.
- To meet the withdrawal deadline, it is sufficient to send the withdrawal statement before the deadline expires.
- The withdrawal statement should be submitted:
- by e-mail to: store@snappform.com;
- in writing to: ul. Stefana Batorego 18 lok. 108, 02-591 Warsaw, Poland, marked “Withdrawal from the agreement”;
- via the Account (user account).
- In the event of withdrawal from an agreement for the supply of Digital Content, the Consumer must stop using that Digital Content and must not make it available to third parties.
- The Seller must refund the price of the Product to the Buyer promptly, no later than within 14 calendar days of the return of the Product.
- The Seller will refund the price using the same payment method used by the Buyer, unless the Buyer has expressly agreed to a different refund method.
- In the event of withdrawal by the Consumer from an agreement for the supply of digital content, the Seller is obliged to refund only the part of the price corresponding to the Digital Content that is not in conformity with the agreement and to the digital content that no longer has to be supplied as a result of the withdrawal.
- The Buyer must return the Product to the address indicated by the Seller promptly, no later than within 14 (fourteen) calendar days of the day on which they withdrew from the agreement. To meet this deadline, it is sufficient to send the Product back before it expires.
- The Consumer is liable for any decrease in the value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics and functioning.
- The Consumer bears the direct costs of returning the Product. Due to the nature of the Products (furniture), they cannot be returned by regular post; the estimated cost of return is PLN 200 to 600 gross, depending on the size and weight of the Product.
- The Product should be sent back in packaging that protects it from damage in transit; it does not have to be the original packaging.
- The Consumer does not have the right to withdraw from a distance contract in the case of:
- an agreement whose subject is a Product made to the Consumer’s specifications or clearly personalised, i.e. a Product with dimensions, shape or finish outside the Store’s standard range, individually agreed with the Consumer before placing the Order. Choosing a colour, finish or variant from the options available in the Online Store does not deprive the Consumer of the right to withdraw from the agreement;
- the supply of Digital Content, if the Seller has supplied the Digital Content or fully performed the digital service with the express consent of the Customer, who was informed before performance began that they would lose the right to withdraw from the agreement.
- The Seller will make the refund using the same payment method used by the consumer, unless the consumer has expressly agreed to a different refund method that does not involve any costs for them.
- The Consumer may use the model withdrawal form provided in Annex 1 to these Terms, but this is not mandatory.
§ 13 FINAL PROVISIONS
